These Terms and Conditions (“Terms”) govern your access to and use of:

• www.perimenopauseathletesummit.com

• All coaching services, programs, courses, memberships, and related services provided by Element Sports Coaching (“Company,” “we,” “our,” or “us”).

By accessing this website or purchasing any service, you agree to be bound by these Terms.

If you do not agree, you must not use our services.

1. ELIGIBILITY

You must be at least 18 years of age to use our services. By using our website or purchasing coaching services, you represent that you are at least 18 years old.

2. SERVICES PROVIDED

Element Sports Coaching provides:

• Endurance sport coaching

• Personalized and group training programs

• Educational courses and memberships

• Summit and webinar content

• Mindset, nutrition, training, and recovery guidance

All services are educational and informational in nature and are not medical services.

3. HEALTH DISCLAIMER

You acknowledge that:

• Coaching services are not medical advice.

• We are not acting as physicians, dietitians, or licensed healthcare providers unless explicitly stated.

• You are responsible for consulting with your physician before beginning any training or nutrition program.

• You voluntarily participate in all training activities at your own risk.

By participating in coaching services, you confirm that you are physically able to engage in athletic training and assume full responsibility for your participation.

4. ASSUMPTION OF RISK

Endurance training and physical activity carry inherent risks, including but not limited to:

• Injury

• Illness

• Cardiovascular events

• Equipment failure

• Environmental hazards

You knowingly and voluntarily assume all risks associated with participation in training programs and athletic events.

5. NO GUARANTEES

We do not guarantee:

• Specific race results

• Performance outcomes

• Injury prevention

• Health improvements

• Financial or professional results

Results vary based on individual effort, physiology, adherence and external factors.

6. PAYMENT TERMS

Payments are processed securely via Stripe.

By purchasing services, you agree:

• To provide accurate payment information.

• That recurring memberships will auto-renew unless canceled.

• To be responsible for all applicable taxes.

We do not store full credit card numbers.

7. REFUND POLICY

Unless otherwise stated in writing:

• Coaching services and memberships are non-refundable.

• Digital products and courses are non-refundable once accessed.

• Summit registrations are non-refundable unless explicitly stated.

We reserve the right to make exceptions at our sole discretion.

8. CANCELLATION POLICY

For recurring memberships:

• You may cancel at any time before your next billing cycle.

• Cancellations must be submitted in writing.

• No partial refunds will be issued for mid-cycle cancellations.

For 1:1 coaching:

• Any notice requirements outlined in your coaching agreement apply.

9. INTELLECTUAL PROPERTY

All content provided through:

• Website

• Kajabi platform

• Training materials

• Courses

• PDFs

• Videos

• Workbooks

• Training plans

Is the intellectual property of Element Sports Coaching.

You may not:

• Reproduce

• Share

• Distribute

• Resell

• Modify

• Record group sessions for redistribution

Without written permission.

10. PLATFORM USE

We may use third-party platforms including:

• Kajabi

• TrainingPeaks

• Athletica

• Stripe

• Zoom

• Google services

Your use of those platforms is also subject to their individual terms and policies.

We are not responsible for platform outages or technical disruptions beyond our control.

11. CONFIDENTIALITY

We respect athlete confidentiality. However:

• Group coaching environments are not private spaces.

• You are responsible for the information you choose to share in group settings.

We will not disclose your personal information except as described in our Privacy Policy.

12. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

Element Sports Coaching shall not be liable for:

• Indirect, incidental, or consequential damages

• Loss of income

• Lost race opportunities

• Injury arising from training participation

• Platform outages

• Third-party service interruptions

Our total liability shall not exceed the total amount paid by you for services in the preceding three (3) months.

13. INDEMNIFICATION

You agree to indemnify and hold harmless Element Sports Coaching, its owners, coaches, contractors, and affiliates from any claims arising out of:

• Your participation in training

• Breach of these Terms

• Misuse of services

• Violation of any law

14. TERMINATION

We reserve the right to terminate access to services if:

• You violate these Terms

• Engage in abusive behavior

• Disrupt community integrity

• Fail to make payment

No refund will be issued in cases of termination for violation of Terms.

15. PRIVACY

Your use of our services is also governed by our Privacy Policy.

By using our services, you consent to data practices described therein.

16. INTERNATIONAL USERS

We operate from Canada but serve clients worldwide.

You are responsible for complying with your local laws.

If you reside in the European Union, you retain rights under GDPR as outlined in our Privacy Policy.

17. GOVERNING LAW

These Terms shall be governed by the laws of:

British Columbia, Canada

Without regard to conflict of law principles.

18. DISPUTE RESOLUTION

In the event of a dispute:

1. Parties agree to attempt informal resolution first.

2. If unresolved, disputes shall be resolved in the courts of British Columbia, Canada.

Nothing in this section limits statutory consumer rights where applicable.

19. MODIFICATIONS

We may update these Terms at any time.

Continued use of our services constitutes acceptance of updated Terms.
